SendOff is a tool for crewing endurance races. It is run by Jason Dupree, and these terms are the agreement between you and them for using sendoff.run.
Section 3 is the one that matters. If you read nothing else, read that. Sections 11, 12 and 13 are the legal limits on what SendOff promises and what it is answerable for. They are set in boxes and in capitals so that nobody can say later that they did not see them.
1. What SendOff does
SendOff lets a crew record a racer's progress through a race: arrivals and departures at aid stations, food and fluid, notes. It shows that to whoever has the link. It works out simple arithmetic from what has been logged, including pace, projected finish, and margin against a cutoff.
2. It is in beta
SendOff is new and is being built while it is being used. Features change and some of them break. Data can be lost. It has run real races and the crew work is solid, but you should not assume any part of it will behave next month the way it does today.
3. It is not a safety system, and it is not official timing
SendOff is a convenience for a crew. It is not:
- the race's official timing. The race organisation's clock is the one that counts.
- a tracking or location system. It knows where a racer is only because somebody typed it in.
- a safety or emergency system. It cannot tell that a racer is in trouble, and it will not tell anybody if they are.
Do not use SendOff to decide whether somebody is safe, whether they should continue, or whether they have made a cutoff. Those decisions belong to the racer, their crew and the race organisation, using the race's own information.
Everything SendOff shows is arithmetic on what was typed in. If a split was logged late, or the phone had no signal, or somebody pressed the wrong button, the numbers will be wrong, and they will not look wrong.
4. Every public race stays readable
A public race stays readable by anybody, with no account and no app, for as long as SendOff runs. That includes after it has finished: the splits, the course, the charts and the printout are all still there. There is no limit on how many of your past races you can see, and there will not be one.
An unlisted race is different, and how it works today is set out in the privacy policy. Read that before you rely on it.
5. Accounts
Accounts are invite only while SendOff is in beta. You need one to run a race. You do not need one, or an app, to watch a race somebody has shared with you.
You are responsible for what happens under your account and for keeping your password to yourself. Tell us at info@sendoff.run if you think somebody else has it.
6. What you put in
What you put into SendOff stays yours. You give permission to store it and to show it to the people you have given access to, which is what is needed to run the service and no more.
You are responsible for having the right to put it there. That includes other people's email addresses: invite somebody only if they would expect to hear from you.
7. What you cannot do
Do not use SendOff to break the law, to harass anybody, to hold somebody's information without their knowledge, or to attack the service or the people using it. Do not try to reach races you were not given access to.
8. It will not always be up
There is no uptime promise. SendOff runs on infrastructure that can fail and is maintained by one person. The pit board keeps working without a signal and sends what you logged once the signal returns, but that is a best effort rather than a guarantee, and a device that is lost or wiped before it reconnects takes what it was holding with it.
9. Money
Nothing costs anything today and there is no payment of any kind. If that changes you will be told before it applies to you, and the features that are free at the time you signed up stay free on your account.
10. Ending it
You can stop using SendOff whenever you like and ask for your account to be deleted. We may suspend or close an account that breaks these terms. If the service closes altogether you will be given reasonable notice and a way to get your data out.
11. No warranty
SendOff is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory. Jason Dupree disclaims all implied warranties, including the implied warranties of merchantability, of fitness for a particular purpose, of title and of non-infringement. No warranty is made that SendOff will be uninterrupted, timely, secure, error free, or that any information it shows is accurate. You use it at your own risk.
12. Limit of liability
To the fullest extent the law allows, Jason Dupree is not liable for any indirect, incidental, special, consequential, exemplary or punitive loss arising out of or related to your use of SendOff, including any personal injury, death, property damage, lost data, lost profit, or missed or incorrect race result.
This limit applies even where the claim is based on the sole or partial negligence of Jason Dupree, and it applies whether the claim is brought in contract, in tort, under a statute or on any other basis.
Jason Dupree's total liability for all claims taken together is limited to the greater of what you paid for SendOff in the twelve months before the claim, which today is nothing, or one hundred United States dollars.
Nothing here limits any liability that cannot be limited by law, and some states do not allow some of these exclusions, in which case they apply to you only as far as that state allows.
13. If somebody sues over what you did with it
You agree to defend, indemnify and hold Jason Dupree harmless from any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, brought by anyone else and arising out of the content you put into SendOff, your use of SendOff, your breach of these terms, or your violation of anyone's rights.
This obligation applies even where the claim is based in part on the negligence of Jason Dupree, except to the extent the claim is caused by his gross negligence or wilful misconduct.
In plain terms: if somebody comes after SendOff because of a race you ran, roster you entered or link you shared, that is yours to answer for rather than the tool's.
14. Which law applies, and where
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules.
Any suit, action or proceeding arising out of or related to these terms or to SendOff must be brought only in the state courts of Tarrant County, Texas, or in the federal courts of the Northern District of Texas, Fort Worth Division. You and Jason Dupree each consent to the personal jurisdiction of those courts and waive any objection that they are an inconvenient forum.
15. Changes to these terms
These terms will change. The date at the top says when they last did. Continuing to use SendOff after a change means you accept it.
If a change materially reduces your rights or materially increases your obligations, you will be told at least fourteen days before it takes effect, by an email to the address on your account or by a notice shown in SendOff. Changes that do not do either of those, such as a corrected typo or a clearer wording, take effect when they are published.
